TERMS AND CONDITIONS OF USE – KIROS DIET SRL

This website is operated by Kiros Diet SRL. Throughout the site, the terms “we,” “us,” and “our” refer to Kiros Diet SRL.

Kiros Diet SRL offers this website, including all information, tools, and services available from this site to the user, subject to the user’s acceptance of all terms, conditions, policies, and notices set forth herein.

By visiting our site and/or purchasing products offered for sale by us, you agree to be bound by the following Terms of Service, including the additional terms and policies referenced herein and/or available via hyperlink.

These Terms of Service apply to all users of the site, including, but not limited to, browsers, vendors, and customers.

SECTION 1 – SITE TERMS

By accepting these Terms of Service, you represent that you are of legal age.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction while using the Service.

Definitions and Terms

KIROS DIET – is the trade name of Kiros Diet SRL, a Romanian legal entity with its registered office in Bucharest, 33 Argentina Street, registered in the Trade Register under number J40/2843/2021, with unique tax identification number (CUI) 30021692.

Seller – KIROS DIET or any of its partners.

Buyer – any natural person over the age of 18 or legal entity who creates an Account on the Website and places an Order.

Customer – any natural person over the age of 18 or legal entity who has or obtains access to the Content, through any means of communication made available by KIROS DIET (electronic, telephone, etc.) or based on an existing usage agreement between KIROS DIET and the Customer that requires the creation and use of an Account.

User – any natural person over the age of 18 or legal entity registered on the Site who, by completing the Account creation process, has accepted the Site’s specific terms in the General Terms and Conditions section.

Account – a section of the Site consisting of an email address and a password that allows the Buyer to place Orders and that contains information about the Customer/Buyer and the Order history (tax invoices, warranties, etc.). The User is responsible for the accuracy, completeness, and timeliness of the data entered.

My Cart – a section of the Account that allows you to add Goods or Services to purchase immediately or at a later time; if no immediate purchase is made, the Buyer/User may receive Commercial Communications regarding the products in the Cart.

Site – the online store hosted at www.kirosdiet.com and its subdomains.

Order – an electronic document serving as a means of communication between the Seller and the Buyer, through which the Buyer expresses the intention to purchase Goods from the Site.

Goods – any product listed on the Site, including those specified in the Order, to be supplied by the Seller to the Buyer pursuant to the Contract.

Campaign – a commercial display of a limited number of Goods, with limited stock and a time period defined by the Seller.

Contract – a distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the parties.

Content – includes:

• all information on the Site;
• the content of any email sent by the Seller to Buyers;
• any information communicated by an employee or representative of the Seller to the Buyer;
• information regarding Goods/Services and/or rates of the Seller or third-party partners.

Document – these Terms and Conditions.

Commercial Communications – any message (email/SMS/phone/push notification, etc.) containing general or topic-specific information, offers, promotions, similar or complementary products, market research, and opinion surveys.

Transaction – collection or refund of an amount resulting from the sale of a Good and/or Service by KIROS DIET to the Buyer, via the payment processor.

Specifications – all specifications and/or descriptions of the Goods and Services as set forth in the relevant product pages.

Payment – payment service provided by the processor integrated into the Site for card payments.

SECTION 2 – GENERAL TERMS AND CONDITIONS

Scope of Application

These Terms and Conditions govern:

• distance selling pursuant to Directive 2011/83/EU and OUG 34/2014 (Romania);
• product conformity in accordance with Regulation (EU) 2019/1020 and Romanian Law No. 449/2003 (statutory warranty);
• food safety in accordance with Regulation (EC) No. 178/2002 and Romanian Law No. 150/2004;
• the protection of personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Romanian Law No. 190/2018;
• dispute resolution in accordance with Regulation (EU) No. 524/2013 (ODR);

e-commerce regulations in accordance with Directive 2000/31/EC and Romanian Law No. 365/2002 and Italian regulations.

Pre-contractual Information

Prior to the conclusion of the Contract, the Customer receives all mandatory information required by Directive 2011/83/EU and OUG 34/2014, including:

• main characteristics of the products
• the Seller’s identity and contact details
• total price, including taxes
• delivery costs
• payment and delivery terms
• Conditions of the right of withdrawal
• Exclusions from the right of withdrawal
• Legal warranty of conformity

Conclusion of the contract

The Order submitted by the Customer constitutes an offer to purchase.

The Contract is considered concluded when the Customer receives the shipping confirmation from the Seller.

The Seller may refuse or modify an Order in the event of:

• product unavailability
• obvious pricing errors
• suspected fraudulent activity
• non-payment
• incomplete or incorrect information provided by the Customer

SECTION 3 – ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if the information on the site is not accurate, complete, or up-to-date. The material is provided for general informational purposes only.

SECTION 4 – CHANGES TO THE SERVICE AND PRICES

• The prices displayed next to the products on the www.kirosdiet.com online store are in euros (EUR) and do not include VAT.
• VAT is added at the time of payment.
• Payments are processed through Shopify-certified payment processors.
• Card details are not stored by the Seller.
• Any currency conversion fees are the responsibility of the Customer.
• Invoices are issued exclusively in electronic format.
• Product prices are subject to change without notice.

SECTION 5 – PRODUCTS

Products may be in limited quantities and are subject to our Return Policy.

We make every effort to accurately represent colors and images, but we do not guarantee the accuracy of the display on your device.

Food Safety

(EC Regulation 178/2002 + Romanian Law 150/2004)

Dietary supplements must be:

• safe
• unadulterated
• unadulterated
• properly stored

Opened or damaged products cannot be returned.

Delivery

• Delivery is handled by European couriers.
• The Customer must verify the integrity of the packaging and report any damage.

SECTION 6 – BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse orders, limit quantities, or cancel suspicious purchases.

You agree to provide current and complete information to ensure proper order processing.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is,” without any warranties or liability.

SECTION 8 – THIRD-PARTY LINKS

We are not responsible for the content, services, or products offered by linked third-party sites.

SECTION 9 – COMMENTS, FEEDBACK, AND USER SUBMISSIONS

Any comments or submitted material may be used by us without restriction.

SECTION 12 – PROHIBITED USES

You may not use the site for any unlawful, offensive, or fraudulent purposes, or in any way that infringes upon the rights of third parties.

These Terms constitute the entire agreement between you and Kiros Diet SRL.

These Terms are governed by Romanian law and regulations regarding e-commerce and consumer protection.

Governing Law

The Agreement is governed by:

• European Union law
• Applicable Romanian legislation (Government Emergency Ordinance 34/2014, Law 365/2002, Law 449/2003, Law 150/2004, Law 190/2018)

Jurisdiction

All disputes shall be resolved exclusively by the competent courts of Bucharest, Romania.

SECTION 19 – CHANGES TO THE TERMS OF SERVICE
